WE ARE, IN NO CASE, LIABLE FOR ANY SUCH INCIDENTAL, SPECIAL, OR SIGNIFICANT DAMAGE FROM USING OR BEING INCAPABLE OF USING OUR SITE. Our supreme obligation to you under all conditions will be equivalent and identical to the attainment price you pay for any goods, services, or information.

  • Third-Party Services :

    We offer you access to or advertise third-party merchant sites ("Merchants"). Here, you can buy the cards. We do not regulate the products or services offered by these Merchants. They can handle all the necessary aspects of order dispensation, contentment, billing, and customer service. We are not involved in transactions between you and Merchants. YOU NEED TO AGREE THAT USING SUCH MERCHANTS IS AT YOUR OWN RISK. YOU WOULD DEMAND OR CLAIM ANY WARRANTIES FROM US, INCLUDING WARRANTIES OF LABEL, SUITABILITY FOR RESOLUTION, MERCHANTABILITY, OR NON-INFRINGEMENT.   • Payments :

    You represent and license that if you are buying something from us or our Merchants, (a) any credit card information you supply is true, precise, and complete, (b) charges incurred by you will be honored by your credit card company, and (c) you will pay the charges incurred by you at the posted prices, including any shipping fees and appropriate or valid taxes.

  • Billing and Shipping Errors :

    CashUp Gifts may cancel orders for out-of-stock items or items omitted by our shipping department. If notified of an omission, CashUp Gifts may reship the missing item at no cost to the buyer at our discretion. If we choose not to reship, a refund for the omitted item will be processed within 24-72 hours. If additional or higher-value cards are shipped, the buyer must notify CashUp Gifts within 7 business days. We will provide a free return shipping label. CashUp Gifts reserves the right to charge the buyer for the balance if the card is not returned.

  • Securities Laws :

We strongly encourage our clients to contact us to return the products they purchased. No product can be returned for a like item or a cash refund. Additionally, orders cannot be canceled once they have been placed.

  • Goods Not As Described In A 45-Day Return Policy :

    If a gift card is found to be fraudulent or has a balance discrepancy, contact us within 45 days of purchase. We will investigate, and if the issue is not due to your use, we will replace the card or issue a refund. The customer must return the purchase via an authorized trackable shipping company before receiving a refund or replacement. This policy only applies to claims made within 45 days of purchase; claims after 45 days will not be refunded, even if the issue occurred within 45 days. Submit claims to cashupgift@gmail.com and keep a copy of the submission for your records. After 45 days, CashUp Gifts is not responsible for balance discrepancies or canceled cards. Physical cards may need to be returned. CashUp Gifts honors returns or refunds that we will categorize under this class for claims made before 45 days of the buying them. Claims made after the first 45 days of the purchase date will not be entertained. We will deny any processing even if the balance discrepancy or cancellation occurred within 45 days.

    The terms below apply to Sellers who use CashUp Gifts to sell or trade gift cards. If there's a change in gift card balance after CashUp Gifts has paid the Seller, and if CashUp Gifts believes the Seller's use caused the change, the use of the card's original Seller, an affiliate of the Seller, or due to suspected fraudulent activity leading to a freeze or cancellation by the issuing merchant (collectively termed "Bad Cards"), CashUp Gifts has the right to charge back the Seller's payment method. It includes ACH withdrawals or charges to a credit card provided by the Seller. If CashUp Gifts cannot make a withdrawal or charge, or if there are cards from the Seller in CashUp Gifts' possession for which payment has not been made, CashUp Gifts may withhold payment or deduct the corresponding amount from future payments. If the Seller proves unsuccessful to issue a refund as required, CashUp Gifts may seek reimbursement through legal means, with the Seller responsible for legal fees and costs.

    CashUp Gifts denies being accountable or answerable when the gift card issuance merchant fails to admit it upon announcing insolvency or because of changes to its gift card acceptance policy.

  • Shipping Policy :

    CashUp Gifts always strives to ship orders quickly. We take the right steps, preferably within 1-2 business days of payment processing. Yet, there may be examples where delivery of the car consignment is delayed for a certain number of business days. CashUp Gifts may provide a tracking number as proof of shipment to guarantee transparency and any other vulnerability. Once the tracking number indicates the order is in transit with the carrier, CashUp Gifts will renounce additional accountability for the consignment delivery.

  • Right To Refuse An Order :

    CashUp Gifts intends to reserve all the rights in the world to deny the use of any order placed with us. Furthermore, there is an error in the value of an order or coupon function. In that case, CashUp Gifts reserves the right to inform bona fide customers or patrons to pay the alteration or abandon the order. CashUp Gifts also reserves the right to cancel the order at any time. We do it to maintain the clarity and safety parameters of the clients and CashUp Gifts.

  • Venue; Applicable Law :

    All movements or records ascending directly or indirectly from this Agreement or your use of the Site (https://www.cashupgift.com/), including samples or products obtained through such use, shall be litigated in the Superior Court of the United States District Court for the District of New Jersey. Using the Site, you submit to this jurisdiction in advance and waive any troublesomeness or inappropriate environment claim. This Site was created and controlled by CashUp Gifts in the USA without giving effect to any principles of conflicts of laws.

  • Lapsed Accounts :

    To maintain current accounts, CashUp Gifts may terminate inactive accounts for 90 days or more. CashUp Gifts will inform and alert the customers via email at least ten days before deactivating their accounts. We follow the process for all our clients. We will terminate the account if we await a response to the email within 10 days. We maintain the same records to maintain transparency in the procedure. To keep the process simple and transparent, we recommended that customers keep their accounts and contact information current. While CashUp Gifts aims to avoid premature termination of active accounts, it is not obligated to maintain accounts that appear abandoned. Failure to access an account for 90 days or more indicates abandonment and may result in termination. We do this to protect the interests of the clients.

  • Verify Customers' Address :

    CashUp Gifts reserves the right to contact a customer via recommended methods. We contact them via email to verify the accuracy of account information (including the correct name and address of the customer) needed to provide the customer with the information they requested from CashUp Gifts.

  • Promotional and Expiration Date :

    CashUp Gifts understands the technicalities and risks of promotional gift cards. We do not accept or deal in promotional gift cards, and we were reluctant to create and follow any restrictions or have an expiration date.

  • Cards From Other Marketplaces :

    CashUp Gifts does not accept and receive gift cards that we had previously purchased from secondary gift card marketplaces, including cards bought or acquired on this Site. We strictly follow these safety parameters as they ensure the best gift card usage experience.

  • Identity and Location Verification :

    Using CashUp Gifts, you authenticate and permit us to request your mobile service provider to verify your individuality using your mobile subscriber details.
